WAIVER OF LIABILITY AND RELEASE AGREEMENT
WILDACRES Blue Mtns – Short Stay Accommodation

1. ACKNOWLEDGEMENT AND ASSUMPTION OF RISK
By proceeding with this booking and staying at WILDACRES Blue Mtns ("the Property"), I, the guest, acknowledge that I am voluntarily renting the Property and assume all risks associated with my stay and that of others who attend the property during the booking, including but not limited to risks of personal injury, property damage, illness, accident, or loss resulting from but not limited to the natural environment, wildlife, terrain, facilities, equipment, and activities undertaken during my stay.

2. RELEASE OF LIABILITY
I hereby release, discharge, and hold harmless the Property owner, managers, employees, agents, and affiliates (collectively, "the Released Parties") from any and all claims, demands, liabilities, damages, costs, and expenses of any kind, whether known or unknown, anticipated or unanticipated, arising from or related to my stay at the Property.

This release applies to, but is not limited to:

• Any injury, illness, or death occurring on or near the Property, regardless of cause.
• Any loss, theft, or damage to personal property.
• Injuries resulting from use of the Property’s facilities, including but not limited to balconies, stairs, pools, hot tubs, fireplaces, outdoor spaces, and kitchen appliances.
• Risks associated with inclement weather, wildlife encounters, uneven terrain, or outdoor activities.
• Any claim arising from the conduct of other guests or third parties.

3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, costs, and expenses (including reasonable legal fees) brought by me, my guests, or any third party as a result of my stay at the Property.

4. RESPONSIBILITY FOR DAMAGES
I accept full responsibility for any damages caused by myself, my guests, or any associated parties during my stay. I agree that the cost of any necessary repairs, replacements, or additional cleaning required due to negligence or misuse will be charged to me.

5. COMPLIANCE WITH HOUSE RULES AND LAWS
I agree to abide by all house rules provided before or during my stay. I also acknowledge my responsibility to comply with all local, state, and federal laws during my occupancy at the Property.

6. COVID-19 AND OTHER HEALTH RISKS
I acknowledge that my stay may involve exposure to COVID-19 or other illnesses. I accept all associated risks and agree not to hold the Released Parties liable for any health-related issues that may arise.

7. SEVERABILITY AND GOVERNING LAW
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue to be in full force and effect. This Agreement shall be governed and interpreted in accordance with the laws of New South Wales, Australia.

8. AGREEMENT AND ACCEPTANCE

By completing my booking, I acknowledge that I have read and understood this Waiver of Liability and Release Agreement, and I voluntarily agree to its terms on behalf of myself and all guests or related parties that are associated to my booking
